What is Bankruptcy?

A voluntary bankruptcy case is a legal proceeding brought by a debtor in The United States Bankruptcy Court to discharge certain debts. Its purpose is to give debtors a "fresh start" by discharging or canceling their debts and provide equity to their creditors by fairly distributing the debtor's non-exempt assets among them.

From the moment the petition is filed, the automatic stay stops foreclosures, wage garnishments, lawsuits and collection calls. In a Chapter 7 case, qualifying debts such as credit cards, medical bills and personal loans are discharged, while exempt property is protected. In a Chapter 13 case, the debtor keeps his or her property and pays through a court-approved plan of three to five years, which allows homeowners to catch up on mortgage arrears and save their home from foreclosure.


Short Sale and Short Payoff

If you owe more on your property than it is worth, we negotiate with your lender so that you can get out of the debt without a foreclosure judgment. In a short sale, the property is sold for less than the mortgage balance and the lender accepts the proceeds to release its lien; in a short payoff, you keep or refinance the property and the lender accepts a reduced lump sum as payment in full.

We prepare and submit the hardship package, dispute unrealistic valuations, negotiate the amount the lender will accept and the release of other liens, and seek a written waiver of any remaining balance through the closing.
